Service Membership and Purchases
Launch Health's Services may enable you to become a "Member" through purchases, granting special access to Content ("Order"). We reserve the right to refuse or limit any Order you place. This includes limiting orders per individual or household, and orders made under the same account or credit card, or sharing a billing or shipping address. If we alter or cancel an Order, we'll attempt to notify you using your provided contact details. We may restrict Orders we believe are made by healthcare professionals, resellers, or competitors, or those violating these Terms.
Payment is required before accessing Content, including processing fees and taxes as indicated at the time of your Order. All fees associated with an Order are non-refundable. Launch Health may modify or discontinue any part of the Content at any time without notice. We may also develop and release Service updates, including upgrades, bug fixes, patches, or new features ("Updates"), which may change or remove certain features. We are not obligated to provide any Updates or maintain specific features or functionality.
Content prices are subject to change, and we will notify you of changes by posting on the Services or contacting you directly.
We will correct any errors found and reserve the right to revoke offers and correct inaccuracies or omissions, even after an order is submitted and whether or not it has been confirmed and charged. Launch Health is not liable for any modification, price change, suspension, or discontinuation of the Content.
Launch Health determines the form and format of Content access. Due to licensing, we may change, remove, or replace Content at our discretion, without notice or liability.
Payment Process and Information
For payments made through the Services, you may need to provide relevant details such as credit or payment card numbers, expiration dates, billing and shipping addresses. Subscription Payments and Cancellation Policy
Launch Health's Services may offer subscription options or other payment methods. You can cancel your subscription at any time. Cancellation will be effective from the start of the next billing cycle, allowing you to retain access until the end of the current period. Subscription fees are billed in advance and are non-refundable.
Partial monthly refunds are not provided, even if the subscription is canceled mid-month. For instance, a subscription starting on June 21st will be active until July 21st, unless canceled. If canceled on June 22nd, your access continues until July 21st without further charges. If canceled on July 22nd, the subscription remains active until August 21st, as the billing would have already occurred.
Yearly subscriptions are also paid in advance and are non-refundable. Cancellation during the annual cycle does not entitle you to a refund for any unused portion of the year. Access continues until the end of the paid term. No refunds are available under any circumstances once a payment has been made.
Data Security Acknowledgement
Launch Health implements reasonable measures to safeguard your information, but absolute security cannot be guaranteed. There is a possibility that unauthorized parties might access our servers and view your data or intercept it during transmission over the Internet or other channels. By providing your information to Launch Health, you acknowledge and accept these security risks. Should you choose not to submit your information electronically to avoid these risks, you might be unable to fully utilize our Services. Launch Health is not liable for any breach of data security caused by illegal acts of third parties, such as hacking or other similar activities.
Consent to Communication Methods
By using Launch Health's Services, you consent to our communication with you via all contact methods you have provided, including but not limited to text messages, emails, phone calls, social media interactions, fax, and postal mail.
Disclaimer, Indemnification, and Limitation of Liability

We do not warrant that the Services will be uninterrupted, error-free, or free from harmful components such as viruses. Users should protect themselves with anti-virus software. We make no claims about the validity, accuracy, or reliability of the Services or the information published on them.
In jurisdictions that do not allow the exclusion of certain warranties, these exclusions may not apply. Launch Health, its affiliates, and their respective directors, officers, employees, or agents will not be liable for any losses or damages arising from your use or inability to use the Services or reliance on information provided therein. This includes all types of damages, direct or indirect, under any theory of law. If any part of this limitation of liability is found to be invalid or unenforceable, then Launch Health's liability will be limited to the greater of $100 or the amount of fees you paid to Launch Health in the preceding twelve months.
Arbitration Agreement
Any dispute or claim ("Claim") arising from or related to these Terms of Service will be resolved through arbitration by a neutral arbitrator, in accordance with the rules of a recognized Canadian arbitration association for commercial disputes. Claims must be presented individually and not as part of a class action. The arbitration will take place in a location determined within Canada. The arbitration process, including submissions, proceedings, and the final award, will remain confidential. The arbitration will be conducted swiftly with limited discovery, and the arbitrator's decision will be conclusive and binding. Each party shall bear their own costs of any such arbitration. Provided however that if Launch Health is successful in the arbitration you shall be responsible to reimburse Launch Health for all costs incurred by it in respect of the arbitration.
Governing Law and Legal Proceedings
All claims and usage of Launch Health's Services are subject to the laws of the Province of Alberta, Canada, without regard to its conflict of law principles.
For the enforcement of any arbitration decision, or if arbitration is not applicable, any legal claims or actions related to the Services will fall under the jurisdiction of Alberta's courts. Launch Health reserves the right to initiate proceedings against you for a breach of these Terms in your country of residence or any other applicable jurisdiction. You waive any objections to the jurisdiction and venue of these courts.
Prior to invoking any arbitration for any harm related to the use of the Services, you agree to notify us in writing and provide a 30-day period to address the issue. Any legal claim must be submitted for arbitration within one year from when the claim arose; failure to do so will result in the barring of that claim.
Waiver of Class Actions
You agree that any legal claim or dispute arising from or connected to these Terms of Service or the use of Launch Health's Services will be conducted on an individual basis. You renounce the right to participate in any class action or collective legal proceedings against Launch Health.
General Provisions
You are not permitted to transfer any rights or obligations under these Terms of Service without the express written consent of Launch Health. Launch Health retains the right to assign these Terms of Service, in part or whole. Provisions of these Terms designed to remain valid after termination or expiration will continue to be in effect. No waiver of any provision hereunder shall be considered a further or ongoing waiver of such provision or any other provision.
These Terms of Service, along with the Privacy Policy, form the complete agreement between you and Launch Health, superseding any prior agreements regarding this subject matter. If any part of these Terms is deemed unenforceable, it will be modified to the minimum extent necessary to make it enforceable, or if this is not possible, it will be severed, with the remaining provisions continuing in full effect.
